Mediation and Alternative Dispute Resolution (ADR)
At the heart of all litigation is Conflict: Two Competing Interests. These interests of often buried under heated verbal or written exchanges, often taking the form of firm and unwavering demands. These demands sometimes do not accurately reflect the actual wants and interests of the parties. They are usually backed by feelings of distrust, pain and fears – and therefore often do not reflect reasonable and realistic interests, but rather guards and barriers that must be broken down and tackled. Mediation and Alternative Dispute Resolution is the legal art of breaking down ‘demands’ into actual ‘interests’ of the parties – so that a reasonable resolution may be achieved.
